Rubbish Clearance Haringey Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Haringey provides waste collection and rubbish removal services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation that requests or purchases services from Rubbish Clearance Haringey.

Company, we or us means Rubbish Clearance Haringey, the provider of rubbish clearance and waste collection services.

Services means any rubbish clearance, waste removal, bulky waste collection, or associated services supplied by the Company to the Customer.

Waste means any items, materials, rubbish, junk, or refuse that the Customer asks the Company to remove, except where specifically excluded under these Terms and Conditions or by law.

Contract means the agreement between the Customer and the Company for the provision of Services, formed upon confirmation of a booking in accordance with these Terms and Conditions.

2. Service Area and Availability

The Company provides rubbish clearance and waste removal services primarily within the Haringey area and nearby locations. Service availability may vary depending on demand, access, and operational constraints. The Company reserves the right to decline a booking if the location is outside its usual operating area or where service provision is impractical or unsafe.

All bookings are subject to availability of vehicles, staff and equipment. The Company may offer alternative dates or times where the requested slot is not available.

3. Booking Process

3.1 A booking may be made by telephone, email, or online enquiry. The Customer must provide accurate and complete information about the type and quantity of waste, the property access, parking restrictions, and any other relevant details.

3.2 Any quotation provided prior to collection is based on the information supplied by the Customer. If, upon arrival, the actual volume, weight, type of waste, or access conditions differ from those described, the Company reserves the right to adjust the price, modify the scope of the Services, or decline to carry out the work.

3.3 A Contract is formed only when the Company confirms acceptance of the booking, whether verbally or in writing, and a date and time window for the Service has been agreed.

3.4 The Customer is responsible for ensuring someone over the age of 18 is present at the property at the agreed time to grant access and approve the items to be removed, unless otherwise agreed in advance.

4. Quotations and Pricing

4.1 Quotations are normally based on estimated volume and type of waste. Final charges will be confirmed on site once the load has been assessed by the collection team.

4.2 Prices may vary depending on the volume, weight, type of waste, special handling requirements, and any parking or access constraints. Additional charges may apply for heavy materials, hazardous waste, or difficult access.

4.3 All prices are quoted in pounds sterling and, unless expressly stated otherwise, are exclusive of any applicable VAT or government levies. Any such charges will be added to the final invoice where applicable.

4.4 The Company reserves the right to revise its prices at any time. Price changes will not affect confirmed bookings unless the scope of Services changes or the information originally provided by the Customer was inaccurate.

5. Payments and Invoicing

5.1 Payment is due on completion of the Service, unless otherwise agreed in writing. The Company may require a deposit or full prepayment at the time of booking, particularly for large or commercial clearances.

5.2 The Company accepts common UK payment methods, which may include cash, debit or credit card, and bank transfer. Some payment methods may not be available for all bookings and the Company will confirm acceptable methods when taking the booking.

5.3 Where the Customer is a business and credit terms have been agreed in advance, payment must be made within the timeframe stated on the invoice. If no timeframe is specified, payment is due within 14 days of the invoice date.

5.4 If payment is not received by the due date, the Company reserves the right to charge interest on the overdue amount at the statutory rate permitted in the UK for late payment, together with any reasonable costs incurred in recovering the debt.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving notice to the Company. Cancellations or changes must be communicated by telephone or email.

6.2 Where the Customer cancels more than 24 hours before the scheduled collection time, any deposit paid may be refunded or applied to a future booking at the Companys discretion.

6.3 Where the Customer cancels less than 24 hours before the scheduled collection time, or fails to provide access to the property at the agreed time, the Company may charge a cancellation fee to cover lost time, travel costs and operational expenses.

6.4 The Company reserves the right to cancel or reschedule a booking due to vehicle breakdown, staff illness, adverse weather, unsafe conditions, or other circumstances beyond its reasonable control. In such cases, the Company will offer an alternative appointment. The Company will not be liable for any indirect loss, such as loss of earnings, caused by such cancellations or rescheduling.

7. Customer Obligations

7.1 The Customer must ensure that:

(a) The waste to be collected is clearly identified and accessible at the agreed time.

(b) Any necessary permissions for access, loading or parking are in place, including permits where required.

(c) There are no health and safety risks that the Customer has failed to disclose, such as dangerous structures, sharps, or hazardous substances.

7.2 If the collection team considers access to be unsafe or obstructed, or the waste to be materially different from that described at the time of booking, the Company may refuse to proceed with the Service or may vary the price accordingly.

7.3 The Customer must not present for removal any items that are prohibited by law or by these Terms and Conditions, including but not limited to: asbestos, clinical waste, certain chemicals, gas bottles, explosives, and other hazardous materials, unless the Company has expressly agreed in writing to handle such items and the appropriate arrangements have been made.

8. Waste Handling and Regulations

8.1 The Company operates in accordance with applicable UK waste management legislation, including duties relating to the storage, transport and disposal of controlled waste.

8.2 The Company will transport waste only to authorised transfer stations, recycling facilities or disposal sites, and will use reasonable efforts to divert waste from landfill where practical, in line with environmental best practice.

8.3 Where required, the Company will issue a waste transfer note or other relevant documentation for the collection. The Customer is responsible for retaining any such documentation for their own records and for any regulatory purposes.

8.4 Ownership of waste transfers to the Company once the items have been loaded onto the vehicle, except where otherwise required by law or where an item is later found to be hazardous or prohibited. In such cases, the Company may return the item to the Customer or arrange for specialist disposal at the Customers cost.

9. Excluded Items and Additional Charges

9.1 Certain items may incur additional charges due to specialist handling or disposal requirements. These may include mattresses, tyres, fridges, freezers, electrical appliances, paint, and other items subject to specific disposal rules.

9.2 Hazardous or specialist waste will only be accepted by prior agreement and may be subject to separate terms, documentation, and pricing.

9.3 If, during the Service, the team discovers excluded or hazardous items that were not disclosed at the time of booking, the Company may refuse to remove those items, or may agree to do so for an additional charge. The Customer will be notified of any such charges before the work proceeds.

10. Liability and Limitations

10.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company shall not be liable for any damage or loss arising from pre-existing defects, wear and tear, or structural weaknesses at the property.

10.2 The Customer should move or protect any fragile items, floor coverings, or decorations that may be at risk during the clearance process. The Company will not be responsible for minor scuffs or marks that occur as a result of normal handling and movement of bulky items.

10.3 If the Customer wishes the team to remove items from lofts, basements, roofs, or other challenging areas, this will be at the Customers risk and only where it is safe to do so. The Company reserves the right to decline work in any area it considers unsafe.

10.4 The Companys total liability for any claim arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Service giving rise to the claim.

10.5 Nothing in these Terms and Conditions shall exclude or limit the Companys liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot lawfully be excluded or limited under UK law.

11. Insurance

The Company maintains appropriate insurance cover for its operations in relation to rubbish clearance and waste collection. This may include public liability and employer’s liability insurance. Details of cover can be provided to the Customer on request.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Service, they should contact the Company as soon as possible, giving full details of the issue.

12.2 The Company will investigate complaints promptly and will seek to resolve them through discussion with the Customer. The Customer must allow the Company a reasonable opportunity to inspect any alleged damage or service issues before arranging repairs or third-party services.

12.3 If a dispute cannot be resolved informally, the parties agree to attempt to settle the matter through negotiation before commencing any formal legal proceedings.

13. Data Protection and Privacy

13.1 The Company will collect and process personal data about the Customer for the purposes of managing bookings, providing Services, processing payments, and satisfying legal and regulatory obligations.

13.2 The Company will take reasonable steps to keep personal data secure and will not share it with third parties except where necessary to perform the Services, process payments, or comply with legal requirements.

14. Force Majeure

The Company shall not be in breach of contract or otherwise liable for any delay in performance or failure to perform any of its obligations under these Terms and Conditions if such delay or failure is caused by events beyond its reasonable control. Such events may include, but are not limited to, extreme weather, strikes, accidents, traffic disruption, civil unrest, or changes in law or regulations.

15. Variation of Terms

The Company may amend these Terms and Conditions from time to time. The version applicable to a particular booking will be the version in force at the time the booking is confirmed. Customers are advised to review the Terms and Conditions periodically if they use the Services on a recurring basis.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of rubbish clearance and waste collection services by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation issued by the Company, constitute the entire agreement between the Customer and the Company in relation to the provision of the Services. No other statement, representation or promise shall be binding unless expressly agreed in writing by the Company.
